1. Introduction
Welcome to Moments to Frames Studio. These Terms of Service ("Terms") govern your use of our website (momentstoframesstudio.com), our photography services, and any related communications or applications. By booking a session, using our website, or interacting with our services, you agree to these Terms.
2. Booking & Retainer
- To secure a photography session, a non-refundable retainer fee is required at the time of booking.
- The remaining balance is due on or before the day of your session.
- Prices and packages are subject to change. Your rate is locked in once your retainer is paid and contract is signed.
3. Cancellations & Rescheduling
- The booking retainer is non-refundable.
- We allow one (1) complimentary reschedule if requested at least 48 hours prior to your session.
- Further reschedules may be subject to a rescheduling fee of $25 CAD per occurrence.
- If the client fails to show up for their scheduled session without notice, the session and all payments will be forfeited.
4. Delivery of Images
- Proof galleries will typically be delivered within 24-48 hours after your session.
- Once final selections are made, fully retouched images will be delivered within 5-7 business days unless otherwise specified.
- Raw, unedited files are not provided to clients. Only finalized, high-resolution JPEGs will be delivered.
5. Copyright & Usage Rights
- Moments to Frames Studio retains the copyright to all images captured during your session.
- Clients are granted a personal, non-exclusive license to use, download, and print the images for personal purposes.
- Images may not be altered (including adding social media filters) or used for commercial purposes without explicit written consent from the studio.
- The studio reserves the right to use images for promotional purposes, portfolio, social media, and advertising, unless a specific privacy request is made and agreed upon in writing prior to the session.
6. Liability
- Moments to Frames Studio takes utmost care with respect to exposure, transportation, and processing of photographs. However, in the unlikely event that photographs are lost, stolen, or destroyed for reasons beyond the studio's control, liability is limited to the return of all payments received for the session.
- The studio is not responsible for any personal injuries or property damage arising during sessions, whether in-studio or on location.
